Trial in HBTS shooting ends in hung jury

The trial of attempted murder suspect John Marshall Fitzgerald, 60, ended in a mistrial Friday, Aug. 19 after the jury could not reach an agreement. The case will be retried in the coming weeks.

Fitzgerald is charged with attempted murder and assault with a deadly weapon in the Oct. 30, 2015, shooting of Nelson “River” Starkey. During the incident, Starkey was shot multiple times including twice to the head at a residence on Valley Road in Holley by the Sea.

Starkey, a University of North Alabama senior, received traumatic brain injuries and is hospitalized in Atlanta where his family makes four-our trips from their home in Florence, Ala. to spend time with him.

He is able to communicate by drawing on a tablet.
