A Navarre man serving life in prison for aggravated battery granted a new trial by the Florida First District Court of Appeal May 13.
Timothy Donald Helton, 46, was convicted in 2013 of battery and aggravated battery with a deadly weapon causing great bodily harm following an argument at a Navarre residence on May 31, 2011.
According to the report Helton struck one man and beat another so severely he fractured his skull.
Helton used Florida’s “stand your ground” law as his defense, and the appellate court determined jury members received incorrect instructions when applying the defense.
